Terms of Use
Last updated:
These Terms of Use (“Terms”) are an agreement between you and Nicraft (“we”, “us”). They govern the Bangs app for macOS (“Bangs” or “the app”), its updates and licenses, and this website. By downloading, installing or using Bangs, you agree to these Terms. If you don’t agree, don’t use Bangs. Nothing in these Terms limits rights you have under consumer protection laws that can’t be waived.
1. Plans and features
Bangs offers free features and paid features. The website, the app and the checkout page describe the following, as they apply at the time:
- which features are free and which are paid;
- how long any free trial lasts;
- what a paid license includes, such as the number of Macs and the versions covered.
The description shown when you buy is part of these Terms for your purchase. We may add, change or remove features in new versions. Changes never reduce what a license you have already bought covers.
2. Your license to use Bangs
We grant you a personal, non-exclusive, non-transferable license to install and use Bangs on Macs you own or control. The license is subject to these Terms.
-
Free features. You may use the free features for as long as we offer them.
-
Trials. A trial unlocks paid features for the period stated in the app. When it ends, paid features stop working until you buy a license. Free features keep working.
-
Paid licenses. Unless the purchase page says otherwise:
- a license is a one-time purchase, not a subscription;
- it can be activated on the number of Macs stated at purchase;
- it includes updates for the versions stated at purchase, for example all 1.x updates.
A later major version may require a new purchase. That doesn’t affect your right to keep using the versions your license covers.
-
Activation. Activating a license may require an internet connection, at least the first time. You may deactivate a Mac to move your license to another one. Keep your license key private. Sharing or publishing it isn’t allowed.
The license gives you the right to use Bangs. It doesn’t give you ownership of Bangs or its code.
3. Purchases, prices and taxes
Purchases are processed by a third-party payment provider. It may sell Bangs to you as reseller (“merchant of record”) and is named at checkout. Its terms also apply to the payment. Prices, currency and any taxes are shown at checkout before you pay. Prices may change, but changes don’t affect purchases already completed.
4. Refunds
The refund policy that applies to your purchase is stated on the purchase or checkout page. It will never give you less than the law where you live requires. If a purchase is refunded or reversed, we may deactivate the license. A Mac that is offline learns of this the next time it connects.
5. Updates
We may provide updates that fix problems, improve compatibility or change features. Bangs may check for and download updates automatically, as described in its settings. Some updates may be needed to keep Bangs working or secure. We provide security and compatibility updates for supported versions for a reasonable period. We can’t promise that Bangs will keep working with every future version of macOS or of other apps.
6. Previews and betas
We may offer preview, beta or test versions. They may be unstable or incomplete, may stop working after a set time, and may change or lose features before release. Using one doesn’t entitle you to a paid license.
7. Acceptable use
You may not:
- copy, sell, rent, sublicense or redistribute Bangs or license keys, except as these Terms allow;
- bypass, disable or interfere with licensing, security or update features;
- reverse engineer, decompile or disassemble Bangs, except where the law allows it despite this restriction;
- remove copyright, trademark or other notices;
- use Bangs unlawfully or to infringe the rights of others.
8. Your content and data
Your clipboard history, file shelf and settings are stored on your Mac. You are responsible for them, including what you copy, paste and share. Bangs is a convenience tool, not a backup or archive service. Content may be removed under the retention settings (by default, items unused for 7 days are removed automatically; you can change this in Settings), when you clear it, or when your Mac or its storage fails. The sensitive-content filter can’t catch everything, so don’t rely on it to protect passwords or confidential information. Our Privacy Policy explains how information is handled.
9. macOS permissions and third-party services
Some features need macOS permissions or work with other apps and services, such as music apps. Those apps and services are governed by their own terms, and can change in ways that affect Bangs. We don’t control them. Bangs is not affiliated with, endorsed by or sponsored by Apple, Spotify or any other third party it works with.
10. Feedback
If you send us suggestions or feedback, including through the waitlist, we may use them to improve Bangs. We have no obligation to you for doing so.
11. Intellectual property and trademarks
Bangs, including its code, design and content, belongs to Nicraft and is protected by intellectual property laws. Nicraft owns the trademarks “Bangs” and the Bangs logo. These Terms don’t give you any right to use them. Other names and trademarks belong to their owners.
12. Disclaimer
To the extent permitted by law, Bangs is provided “as is” and “as available”. We make no warranty that it will meet every need, or be uninterrupted, error-free or always compatible. We also make no warranty that data it stores can always be recovered. This doesn’t affect any warranty or right that the law gives you and that can’t be excluded.
13. Limitation of liability
To the extent permitted by law, we are not liable for any of the following:
- indirect, incidental, special or consequential losses;
- loss of data, profits or business.
Our total liability for any claim relating to Bangs is limited to the amount you paid for Bangs in the 12 months before the claim.
These limits don’t apply to liability for intentional misconduct or gross negligence, or to any other liability that the law doesn’t allow us to limit.
14. Termination
You may stop using Bangs and uninstall it at any time. If you seriously or repeatedly breach these Terms, we may suspend or end your license. Where practical, we’ll notify you first and give you a chance to fix the problem. Sections 7 to 16 continue to apply after termination.
15. Governing law and disputes
These Terms are governed by the laws of Taiwan (Republic of China). Disputes are decided by a court with jurisdiction under Taiwan law. If you are a consumer, you keep any protection that the mandatory laws of the country where you live give you, including the right to bring proceedings there where those laws allow it.
16. Changes to these Terms
We may update these Terms as Bangs and the law change. The date at the top shows the latest version. We’ll announce significant changes on this website or in the app before they take effect. If you keep using Bangs after a change takes effect, you accept the updated Terms. Changes don’t retroactively reduce what a completed purchase covers.
17. General
- If any part of these Terms is found unenforceable, the rest still applies.
- Not enforcing a right immediately doesn’t waive it.
- These Terms, the Privacy Policy and the purchase details shown at checkout are the entire agreement between you and us about Bangs.
- These Terms are available in English and Traditional Chinese. If the versions differ, the Traditional Chinese version prevails, to the extent permitted by law.
